Important reforms to Australia’s copyright framework pass the Parliament
In summary, the Copyright Amendment Bill 2026 amends the Copyright Act 1968 to:
1. Establish an orphan works scheme to facilitate the use of orphan works by limiting the remedies that are available for infringing uses of orphan works, subject to specified search, record and notice requirements.
2. Clarify that the copyright exception relating to the performance and communication of copyright material in the course of giving educational instruction applies to online and hybrid educational environments
This is a signficant achievement for ALACC members and partners and a boon to libraries and archives nationally.
“Australians, including educators, students and the creative sector, now have legal certainty when it comes to the use of copyright material considered ‘orphaned’, unlocking their potential for learning, innovation and public benefit,” says Attorney General, Hon. Michelle Rowland MP.
“The Albanese Government believes that every child should have access to the best education possible, regardless of their circumstances.”
“We’re ensuring the Copyright Act applies consistently to support in-person, online and hybrid classes. This will enrich the educational experience by making sure that parents, guardians and others can assist with these lessons.”
